近年來於汽車數量不斷成長，交通事故層出不窮，自民國87及88年汽、機車強制責任保險實施以來，不僅對受害人保障發揮莫大的功用，社會大眾亦漸接受汽、機車保險。由於汽車交通事故案件的日益增多，當事人雙方的賠償問題以及保險理賠皆有賴於肇事責任鑑定的結果，故本研究主要探討目前產險業所新修訂「汽車肇事責任分攤處理原則」內容是否合理，並提出改進之意見，期使目前保險業與鑑定會委員所判定之肇事責任能由分歧漸趨一致，以降低理賠糾紛，並促進社會和諧。
本研究以問卷調查方式來瞭解肇事鑑定委員對於保險業使用「汽車肇事責任分攤處理原則」之看法，探討是否有判定與認知上的差異；調查期間為2007年7月15日至8月20日一共回收了66份，問券對象為14個地區車鑑會與3個覆議會之委員與秘書，經調查顯示於「路段同向事故」與「路段對向事故」部分，保險業與委員意見較為一致，另在「路口事故」部分，不僅保險業與委員則意見相左之處甚多，且各地委員間亦有不一致的現象；因此本研究根據研究結果，建議保險同業與行車事故鑑定委員會，應研擬一致性之肇事責任處理認定準則，以減少未來理賠時之糾紛。

The number of vehicles has been on the increase in recent years, which also leads to an ever-mounting traffic accidents. Since the implementation of the compulsory auto liability insurance in 1998, not only does it serve much to ensure victims’ right, but people in general also gradually accept such an insurance practice. With the increasing cases of traffic accidents, both parties in a case rely on the rule of auto insurance liability adjudication for compensation and insurance claim. This study aims to evaluate if the newly-revised “The contribution rule of automobile liability insurance” by the insurance industry is reasonable, and to offer suggestions for improvement in the hope that the authentication results from both the insurance agency and the committee concerned will be more conforming, which will further reduce claim disputes and contribute to a more harmonious society.
Questionnaires were employed in this study to probe into the accident authentication committee members’ views on the “The contribution rule of automobile liability insurance” by the insurance industry, and evaluate if there is any discrepancy in judgment or perspective. 66 questionnaires were retrieved during the survey period from July 15 to August 20, 2007. The targets included the committee members and secretaries of the 14 local traffic authentication committees and 3 review committees. The study shows that the industry and committee members share a more conforming view on “same direction accidents” and “opposite direction accidents”, while great discrepancies for “intersection accidents” exist not only between the two parties, but also among the local committees. Based on this study, it is advised that the insurance industry and the traffic accident authentication committees work together to devise a consistent set of rules for traffic liability authentication so as to reduce future claim disputes.
